1 \u2013 General<\/strong><\/p>\n\n\n\n 1<\/sup>\u00a0Migflug GmbH (hereinafter referred to as \u00abMiG flight<\/strong>\u00bb) acts as an agent for individual travel services such as flights (hereinafter the\u00a0\u00abTravel services\u00bb<\/strong>). This activity is carried out on the basis of these General Terms and Conditions (GTC). MiGFlug mediates its customers on the basis of paid brokerage orders (hereinafter referred to as\u00a0\u00abBrokerage orders\u00bb<\/strong>) individual travel services from individual service providers, such as flight providers and organizers as well as other travel providers and organizers (hereinafter the\u00a0\u00abService provider\u00bb<\/strong>).<\/p>\n\n\n\n 2<\/sup> The service providers provide the travel services arranged by MiGFlug under their own responsibility and based on their own terms and conditions. MiGFlug's obligations are limited to the brokerage orders, the support of customers and service providers in the processing of the arranged travel services, and the advice and information of customers regarding the brokerage orders.<\/p>\n\n\n\n 2 \u2013 Mediation order<\/strong><\/p>\n\n\n\n 1<\/sup> A single customer (hereinafter the "Customer"<\/strong>) commissions MiGFlug to arrange the desired travel services by submitting an inquiry via the websites or other available means of communication of MiGFlug. Such inquiries represent a binding offer for the customer to conclude an agency agreement, according to which MiGFlug shall arrange the desired travel services between the customer and the respective service providers (hereinafter the "Booking"<\/strong>). Such inquiries also constitute binding offers to conclude a contract with the respective service providers (hereinafter the \u00abTravel service contracts\u00bb<\/strong>).<\/p>\n\n\n\n 2<\/sup> If the travel services requested by the customer according to their booking are available and the respective service providers accept the customer's corresponding offers, a travel service contract is concluded between the customer and the respective service providers. The customer will receive a corresponding confirmation, whereby the arrangement by MiGFlug is subject to any necessary prior information. The prices for the travel services provided by the service providers fully include the costs for the arrangement by MiGFlug.<\/p>\n\n\n\n 3<\/sup> The mutual rights and obligations of the customer and MiGFlug arise from these General Terms and Conditions and any other agreements concluded between the customer and individual service providers. The rights and obligations of the customer and individual service providers are governed exclusively by the respective travel service contracts and any other agreements concluded between the customer and individual service providers. The brokerage contract with MiGFlug is subject to the proviso that the customer submits any necessary written waiver to MiGFlug and signs these General Terms and Conditions.<\/p>\n\n\n\n 4<\/sup> Insurance is the responsibility of the customer.<\/p>\n\n\n\n 3 \u2013 Advice and information<\/strong><\/p>\n\n\n\n 1<\/sup> MiGFlug advises the customer regarding the brokerage orders and the brokered travel service contracts. It forwards travel documents and other information received from service providers to the customer. MiGFlug is not liable for the forwarding of such information, in particular not for information regarding travel requirements such as visa issuance. However, it will endeavor to provide the customer with appropriate advice.<\/p>\n\n\n\n 2<\/sup> For the provision of certain travel services, a medical certificate of fitness is required in advance. The customer is obligated to obtain such a certificate independently and at their own expense from a suitable third party.<\/p>\n\n\n\n 3<\/sup> For the provision of certain travel services, additional information, certificates, confirmations, and declarations are required in advance. MiGFlug will inform and advise the customer in this regard.<\/p>\n\n\n\n 4 \u2013 Right of withdrawal<\/strong><\/p>\n\n\n\n 1<\/sup> For all travel services arranged by MiGFlug, the service providers grant a right of withdrawal if the customer is unable or unwilling to use the desired travel service. MiGFlug will inform the customer of the respective service provider's cancellation policy.<\/p>\n\n\n\n 5 \u2013 Photo, film and sound recordings<\/strong><\/p>\n\n\n\n The customer agrees that MiGFlug may use any photographs, films and sound recordings made in connection with the travel services it arranges for the customer for its advertising and similar purposes.<\/p>\n\n\n\n 6 \u2013 Complaints and assertion of claims<\/strong><\/p>\n\n\n\n 1<\/sup> Complaints and other claims based on brokerage orders must be communicated to MiGFlug in writing no later than seven days after the relevant brokered travel service has been used.<\/p>\n\n\n\n 2<\/sup> In the event of complaints and other claims against service providers, MiGFlug\u2019s obligations are limited to providing all necessary information which \u2013 if available to MiGFlug \u2013 is absolutely necessary for the customer to assert their claims.<\/p>\n\n\n\n 7 \u2013 Liability<\/strong><\/p>\n\n\n\n 1<\/sup> MiGFlug is liable to the customer for brokerage orders exclusively for faithful and proper execution. Any liability\u2014in particular for slight negligence, third-party negligence, the customer's own fault, or force majeure\u2014as well as any liability for travel services, including gross negligence, is excluded to the extent permitted by law.<\/p>\n\n\n\n 2<\/sup> The respective service providers are solely liable for the fulfillment of the arranged travel services, including any defects. In particular, MiGFlug assumes no liability for changes to the travel services that occur after the conclusion of the arrangements between the customer and the service providers.<\/p>\n\n\n\n 8 \u2013 Miscellaneous<\/strong><\/p>\n\n\n\n The customer authorizes MiGFlug to transmit his or her personal data to the respective service providers for the purpose of arranging booked travel services. The customer acknowledges that such personal data may be transferred abroad, and to countries whose data protection standards do not correspond to those in Switzerland.<\/p>\n\n\n\n The entire legal relationship between MiGFlug and the customer is governed exclusively and entirely by Swiss substantive law, in particular Articles 394 et seq. of the Swiss Code of Obligations (CO) regarding the contract. The exclusive place of jurisdiction is Lucerne, Switzerland.<\/p>\n\n\n\n Should any provision of these Terms and Conditions be invalid or void, the validity of the remaining provisions of these Terms and Conditions shall remain unaffected.
