General Terms and Conditions (GTC)
for the arrangement of flights and other travel services by MiGFlug and GoAviator

1. General
- The MiGFlug GmbH (hereinafter «MiGFlug») mediates under the brands MiG flight and GoAviator Individual travel services, in particular flights (hereinafter "travel services"). These General Terms and Conditions apply to all services arranged by MiGFlug, regardless of whether they are offered under the MiGFlug or GoAviator brand.
- MiGFlug acts within the framework of paid Brokerage orders on behalf of the customer and arranges services from third-party providers such as flight operators or tour operators (hereinafter "service providers").
- The actual implementation of travel services is the responsibility of the respective service providers based on their own terms and conditions. MiGFlug is solely responsible for the arrangement, advice, and support during implementation.
2. Mediation contract
- The customer (hereinafter "Customer") places an order with MiGFlug – via its websites or other communication channels – to arrange the desired travel service. This constitutes a binding offer to conclude a brokerage order and a travel service contract with the service provider.
- After acceptance by the service provider, a Travel service contract directly between the customer and the booking agent. MiGFlug confirms the booking and arranges the booking, subject to any additional information required. The booking fee is included in the total price of the travel service.
- The rights and obligations between the customer and MiGFlug are governed by these General Terms and Conditions. The relationship between the customer and the service provider is governed exclusively by their respective contracts.
- Passenger and company liability insurance is provided for all flights offered through MiGFlug or GoAviator. Additional insurance (e.g., cancellation insurance) can be purchased optionally during the booking process (see 4.3).
3. Advice & Information
- MiGFlug advises customers within the scope of its agency agreement and forwards all relevant travel documents and information from service providers. MiGFlug assumes no liability for their accuracy – particularly regarding visa and entry requirements – but strives to provide comprehensive advice.
- On certain flights, particularly under the brand GoAviator (e.g. warbird flights like Mustang, Yak-9, etc.), a medical certificate of fitness This must be obtained by the customer at their own risk and expense.
- Additional documents such as confirmations or declarations may be required – MiGFlug will inform the customer accordingly.
4. Cancellation & Rebooking
- At force majeure (e.g., weather, technical problems, crew illness), an alternative date or airport may be offered. MiGFlug must provide a comprehensible explanation.
- If the customer is unable to participate for other reasons, MiGFlug and the pilot must be informed immediately. Up to 5 days before the flight Rebookings are possible free of charge. After that, a Fee of 25 % of the flight price.
- One Cancellation insurance (Refundable Booking) is offered in the booking process.
- Basically, no refund if cancellation by the customerWe therefore strongly recommend booking as a refundable option (see 4.3) as well as flexible hotel and flight bookings. MiGFlug can always rebook if necessary – e.g., in case of bad weather, crew unavailability, or technical reasons. Flights will only take place if all parties involved are fit to fly and the aircraft is operational.
5. Photo, film and sound recordings
Customers generally agree that Photo, video and sound recordingsImages created as part of the services provided (e.g., cockpit or action shots) may be used by MiGFlug or GoAviator, particularly for marketing purposes. Permission is usually requested in advance. If you do not wish to use them, a brief email notification is sufficient.
6. Complaints & Claims
- Complaints in connection with the brokerage contract are within seven days to be submitted in writing to MiGFlug after completion.
- In the case of claims against service providers, MiGFlug's role is limited to providing relevant information, where available.
7. Liability
- MiGFlug is only liable to the customer for the proper execution of the brokerage contractAny liability – in particular in cases of slight negligence, fault on the part of the customer, acts of third parties or force majeure – is excluded to the extent permitted by law.
- The respective service providers are solely liable for any defects or changes to the travel services arranged. MiGFlug assumes no liability for these.
8. Data Protection & Legal
- The customer authorizes MiGFlug, personal data to service providers – possibly also abroad, even if data protection there does not meet Swiss standards.
- For all legal relationships between MiGFlug (including the GoAviator brand) and the customer, exclusively Swiss law, in particular Articles 394 et seq. of the Swiss Code of Obligations (OR).
- Place of jurisdiction is Lucerne, Switzerland.
- Should any provision of these Terms and Conditions be invalid, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the original purpose.
