General terms and conditions for the provision of flights and other travel services

These Terms and Conditions apply to MiGFlug GmbH and its brands MiGFlug and GoAviator. GoAviator is a trademark of MiGFlug GmbH.

1 – General

  1. MiGFlug GmbH (hereinafter "MiGFlug"), operating under the brands MiGFlug and GoAviator, acts as an agent for individual travel services, particularly flights (hereinafter "travel services"). This activity is carried out on the basis of these General Terms and Conditions (GTC). MiGFlug arranges for its customers individual travel services from service providers (flight providers and organizers, as well as other travel providers) on the basis of paid agency orders (hereinafter "arrangement orders").

  2. The service providers provide the travel services arranged by MiGFlug under their own responsibility and based on their own terms and conditions. MiGFlug's obligations are limited to the brokerage orders, support in the processing of the arranged travel services, and the provision of advice and information to customers.

2 – Mediation order

  1. A customer (hereinafter "Customer") places a binding order with MiGFlug via the website or other means of communication to arrange the desired travel services (hereinafter "Booking"). At the same time, each such request constitutes a binding offer to conclude travel service contracts with the respective service providers.

  2. If the desired services are available and the service provider accepts the offer, a travel service contract is concluded between the customer and the service provider. The prices quoted include all costs for the arrangement by MiGFlug.

  3. The rights and obligations between the customer and MiGFlug arise from these General Terms and Conditions; the rights and obligations between the customer and service providers arise solely from the respective travel service contracts. The prerequisite for the brokerage order is the written signature of these General Terms and Conditions and, if applicable, a waiver.

  4. All flights arranged through MiGFlug are covered by passenger insurance at the aircraft level and liability insurance at the company level. Customers can purchase additional cancellation insurance as a "refundable booking" during the booking process.

3 – Advice and information

  1. MiGFlug provides advice on the placement contract and forwards all information from service providers. Liability for the completeness or accuracy of this information, for example regarding visa regulations, is excluded; however, MiGFlug strives to provide accurate advice.

  2. A medical certificate of fitness may be required for certain services; the customer shall obtain this certificate independently at his or her own expense.

  3. Further information, certificates, or declarations may be required; MiGFlug will inform you accordingly.

4 – Cancellation and postponement

  1. In case of force majeure (weather, earthquake, accident, etc.), MiGFlug may suggest alternative flight times or locations; the relevant reasons remain reserved.

  2. If the customer notifies MiGFlug/Pilot of a cancellation later than 5 days before departure, MiGFlug may charge 25% of the flight price as a rebooking fee. Changes are free of charge up to 5 days before departure.

  3. Cancellation insurance (Refundable Booking) is offered at checkout.

  4. Generally, no refunds are given for cancellations by the customer. Customers are advised to always book refundable services and keep all travel components flexible. MiGFlug may rebook if necessary, e.g., in the event of bad weather or technical instability.

5 – Photo, film and sound recordings

The customer agrees that MiGFlug may use photographs, film, and audio recordings of their flight. Permission will generally be requested before use; if you object, a brief email notification is sufficient.

6 – Complaints and assertion of claims

  1. Complaints and other claims arising from brokerage orders must be communicated to MiGFlug in writing no later than seven days after the service has been used.

  2. In the event of claims against service providers, MiGFlug will provide support by forwarding all necessary information, if available.

7 – Liability

  1. MiGFlug is liable to the customer for brokerage orders solely for proper execution. Liability for slight negligence, third-party negligence, the customer's own fault, or force majeure is excluded.

  2. The respective service providers are solely responsible for the actual provision of travel services and any deficiencies. MiGFlug assumes no liability for subsequent changes to these services.

8 – Miscellaneous

  • The customer authorizes MiGFlug to pass on personal data to service providers for the purpose of mediation, including abroad with different data protection standards.

  • Swiss substantive law applies exclusively (Art. 394 et seq. of the Swiss Code of Obligations). The place of jurisdiction is Lucerne, Switzerland.

  • Should any provision be invalid, the remainder of the Terms and Conditions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely approximates the intended purpose.
